Overview
Welcome to ALMA STUDIO.
These Terms of Service (“Terms”) govern your access to and use of almastudio.ca, including any purchases made through our online store and any related content, features, products, and services (collectively, the “Services”).
Throughout these Terms, “ALMA STUDIO,” “we,” “us,” and “our” refer to ALMA STUDIO.
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing our website, placing an order, or otherwise using our Services, you agree to these Terms and to the policies referenced within them, including our Privacy Policy and Return & Refund Policy.
If you do not agree with these Terms, please do not use our Services.
Nothing in these Terms limits any rights or remedies available to you under applicable consumer protection law.
1. Eligibility and Use of the Website
By using our Services or making a purchase, you represent that you are legally permitted to enter into the transaction under the laws applicable where you live.
You agree to provide accurate, current, and complete information when placing an order or otherwise using our Services.
You may not use our website or Services for unlawful, fraudulent, abusive, or unauthorized purposes.
2. Product Information
ALMA STUDIO makes reasonable efforts to ensure that product descriptions, specifications, photographs, videos, pricing, and other information displayed on our website are accurate.
Because jewelry is photographed and displayed digitally, the appearance of colours, proportions, metal tones, diamonds, and other details may vary slightly depending on lighting, photography, screen settings, and the device used to view the website.
Natural variations in craftsmanship and the made-to-order process may also result in minor differences that do not materially alter the design or specifications of the piece.
Any carat weights, measurements, dimensions, or other specifications stated on a product page may be subject to reasonable manufacturing tolerances unless expressly stated otherwise.
We reserve the right to correct errors or update product information where reasonably necessary.
3. Made-to-Order Jewelry
Unless otherwise stated on the applicable product page, ALMA STUDIO jewelry is made to order.
Because each piece is produced specifically after an order is placed, production times apply before shipment.
Estimated production and delivery information will be provided through our website, product information, checkout process, order confirmation, Shipping Policy, or communications relating to your order.
Customized, engraved, specially sized, personalized, or otherwise modified pieces are produced specifically for the customer and are subject to the conditions described in our Return & Refund Policy.
4. Orders
Submitting an order constitutes an offer to purchase the products listed in your order.
An order is subject to acceptance by ALMA STUDIO. We reserve the right to decline or cancel an order where reasonably necessary, including in cases involving:
- Payment authorization issues
- Suspected fraud or unauthorized transactions
- Incorrect pricing or product information
- Product or production availability
- Technical errors
- Delivery limitations
- Other circumstances that reasonably prevent us from fulfilling the order
If we cancel an order after payment has been successfully processed and no product has been supplied, the applicable amount will be refunded in accordance with applicable law.
Please review your order carefully before completing checkout, including the product, metal colour, ring size, personalization, shipping address, and other selected specifications.
5. Order Cancellations
Customers may request cancellation within 24 hours of placing an order.
Cancellation requests must be sent to:

Please include your order number.
After the 24-hour cancellation period, production may have begun and the order may no longer be cancelled under our voluntary cancellation policy.
This provision does not limit any cancellation rights that may apply under consumer protection laws.
6. Returns, Exchanges and Refunds
Because our jewelry is made to order, purchases are generally final sale once the applicable cancellation period has expired.
Returns, exchanges, damaged or defective items, incorrect orders, resizing requests, custom orders, and warranty claims are governed by our Return & Refund Policy.
Nothing in our Return & Refund Policy or these Terms limits any mandatory consumer rights available under applicable law.
7. Ring Sizes and Customer-Selected Specifications
Customers are responsible for reviewing and selecting the correct ring size and other customer-selected specifications before submitting an order.
If an incorrect ring size is selected by the customer, the item is not eligible for return or exchange solely for that reason.
Depending on the design, resizing may be available for an additional fee. Please contact us for an assessment.
Certain designs cannot safely or reasonably be resized.
8. Prices, Currency and Taxes
Product prices are displayed in the currency indicated on our website or at checkout.
Prices may change without notice, but a price change will not normally affect an order that has already been accepted, except where correction is required because of an obvious pricing or technical error and subject to applicable law.
Applicable sales taxes will be calculated or displayed as required.
Shipping charges, where applicable, will be disclosed before completion of the purchase.
For orders delivered outside Canada, the customer may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country or applicable authorities, unless expressly stated otherwise.
We do not control these government or carrier-imposed charges.
9. Payment
Payment must be successfully authorized through one of the payment methods offered at checkout.
You represent that you are authorized to use the payment method submitted with your order.
Payment information may be processed by Shopify and third-party payment providers in accordance with their applicable terms and privacy practices.
We may take reasonable steps to verify payment or order information when necessary for fraud prevention or transaction security.
10. Production, Shipping and Delivery
Production and shipping timelines are estimates unless expressly stated otherwise as guaranteed.
Detailed information regarding processing, production, shipping, tracking, expected delivery, customs, and delays is provided in our Shipping Policy.
We will make reasonable efforts to fulfill orders within the timelines communicated to customers.
Shipping or delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather, service interruptions, or other unexpected events.
Nothing in this section limits rights that customers may have where goods are not supplied within the time required under applicable consumer protection law.
11. Delivery Information
Customers are responsible for providing a complete and accurate shipping address.
Please contact us as soon as possible if you notice an error in your delivery information.
We cannot guarantee that an address can be changed after an order has entered production or shipment processing.
Where an order is returned because an incorrect or incomplete address was provided by the customer, additional shipping charges may apply before the order can be resent, except where the problem was caused by ALMA STUDIO or otherwise where prohibited by law.
12. Damaged, Defective or Incorrect Items
Every ALMA STUDIO piece is inspected before shipment.
If an item arrives damaged, has a manufacturing defect, or is materially different from the item ordered, please contact us within 48 hours of delivery at:

Please include your order number and clear photographs or videos showing the issue.
Where the issue is confirmed to be the responsibility of ALMA STUDIO, the available resolution may include repair, replacement, or refund depending on the circumstances.
Approved shipping costs arising from an issue caused by ALMA STUDIO will be covered by us as described in our Return & Refund Policy.
13. One-Year Warranty
ALMA STUDIO provides a one-year warranty from the date of delivery against manufacturing defects.
Warranty coverage and exclusions are described in our Return & Refund Policy.
The warranty does not limit any mandatory warranty or consumer rights that may apply under applicable law.
14. Intellectual Property
The content and design of our website, including the ALMA STUDIO name, branding, logos, product imagery, photography, videos, graphics, written content, product descriptions, website design, and other original materials, are owned by or licensed to ALMA STUDIO unless otherwise indicated.
You may access and use the website for personal, non-commercial purposes.
You may not reproduce, copy, distribute, modify, republish, commercially exploit, or otherwise use our protected content without prior written permission, except where permitted by applicable law.
Third-party trademarks and intellectual property remain the property of their respective owners.
15. Reviews, Feedback and Customer Content
If you voluntarily provide a review, testimonial, photograph, feedback, suggestion, or other content to ALMA STUDIO, you represent that you have the right to provide that content and that it does not unlawfully infringe the rights of another person.
Where you expressly submit content for publication or promotional use, you grant ALMA STUDIO a non-exclusive, worldwide, royalty-free licence to reproduce and display that content for reasonable business and promotional purposes, subject to applicable privacy and consumer laws.
We reserve the right to moderate or remove content that is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate.
Nothing in these Terms prevents a customer from publishing an honest review or exercising any right protected by applicable law.
16. Third-Party Services and Links
Our Services may contain integrations, features, or links provided by third parties.
We do not control third-party websites and are not responsible for their content, availability, security, privacy practices, or terms.
Your use of a third-party service may be subject to the terms and policies of that third party.
17. Relationship With Shopify
ALMA STUDIO is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and ALMA STUDIO.
Shopify is not the seller of ALMA STUDIO products and is not responsible for our products, order fulfillment, customer service, warranties, or other obligations arising from purchases made from ALMA STUDIO, except to the extent Shopify separately provides a particular service directly to you.
Your use of Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.
18. Privacy
Our collection, use, disclosure, and handling of personal information is governed by our Privacy Policy.
Information relating to your order may also be processed by Shopify and other service providers necessary to operate our store, process payments, prevent fraud, and fulfill orders.
Personal information supplied for order fulfillment or customer service will not be used by ALMA STUDIO for promotional marketing unless you have separately consented to receive marketing communications, as described in our Privacy Policy.
19. Errors and Inaccuracies
Occasionally, our website may contain typographical errors, incorrect pricing, inaccurate descriptions, availability errors, or other mistakes.
We reserve the right to correct these errors and update information.
If a material error affects an order that you have already placed, we will take reasonable steps to contact you and address the matter in accordance with applicable law.

You may not use our website or Services to:

To the fullest extent permitted by applicable law, ALMA STUDIO will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website or Services where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, nor does it limit statutory consumer rights.
24. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses or claims reasonably arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.
This provision does not impose liability on a consumer beyond what is permitted under applicable law.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.
26. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it.
27. Governing Law
These Terms and transactions with ALMA STUDIO are governed by the applicable laws of British Columbia and Canada, without limiting any mandatory rights or protections that may apply to a consumer based on their place of residence.
Nothing in these Terms requires a consumer to waive a right to bring or participate in proceedings where such a waiver would be prohibited by applicable law.
28. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices, or legal requirements.
The current version will be posted on almastudio.ca, together with the applicable “Last updated” date.
Changes will apply prospectively as required by applicable law and will not retroactively remove rights that have already arisen from an existing transaction.
